Privacy and Your Information

ICE cares about the privacy and security of your information. This Privacy Policy applies to information that ICE collects through the ICE website when you interact with ICE, with other users, and generally with the ICE website.

All information received and controlled by ICE is handled in accordance with this Privacy Policy.

If you do not agree to the terms of this Privacy Policy, please do not access, browse, or use the ICE website. If you choose not to provide certain information required to provide you with products and services offered through the ICE website, you may not be able to access or receive those products or services.

Information ICE Collects From You, Including Personal Information

ICE directly collects information when you:

• contribute code to ICE or submit an ICE Platform Repository Contributor Agreement;
• contact us by completing an online form or by sending an email to ICE, including messages to our support team;
• participate in user surveys; or
• participate in public mailing lists, chat rooms, forums, webinars, and other interactive experiences on the ICE website or sponsored by the ICE team.

ICE also indirectly collects usage information about your visits to the ICE website, as described in the section below titled "Cookies and Tracking Technologies."

ICE encourages you to use discretion before voluntarily sharing Personal Information on the ICE website. The removal of your Personal Information is subject to the processes and limitations described below.

Cookies and Tracking Technologies on the ICE Website

Like many organizations, ICE uses cookies and other common tracking technologies on the ICE website and in email communications. These technologies help ICE better understand how you use the website and your current and future needs regarding ICE products and services, as well as identify ways in which we can improve your experience.

• System administration and security – When necessary to administer systems, maintain security, and ensure the integrity and proper functioning of the ICE website. Without these technologies, some website functions may not operate correctly.

If you reject ICE cookies, some functionality and conveniences of the ICE website may not work properly.
• Opting out of certain third-party tracking and advertising – Some third parties used by ICE for cookies and tracking technologies may provide options to opt out of their tracking by following the processes described on their websites. ICE is not responsible for the effectiveness of any third-party opt-out options.

How Your Information Is Used

ICE uses information, including Personal Information, for the following purposes:

• Operate and improve the ICE website – This includes developing and improving features that support the use of the ICE website at scale and support the ICE community, including through the ICE Marketplace and the ICE Preferred Provider Program. This also includes personalizing the ICE website so that your experience can be tailored to your interests and needs.
• Provide and improve products and services – This includes enabling you to navigate the ICE website and participate in public mailing lists, chat rooms, forums, webinars, and other interactive experiences offered on the ICE website or sponsored by the ICE team.
• Develop and maintain website security and performance – This includes monitoring website availability and performance, developing software solutions, detecting violations of the Terms of Service, and monitoring potential misuse or abuse of the ICE website.
• Communicate with you – This includes notifying you about maintenance and updates to the ICE website, responding to questions regarding the platform and/or ICE Marketplace, providing information about relevant offers, news, products, and services, and, where permitted by applicable law, sending you communications about products or services from selected business partners that may be of interest to you.
• Measure website usage against our goals and mission – This includes conducting analytics to evaluate usage of the ICE Marketplace and access to products and services, and reporting aggregated usage information that does not identify individuals to business partners and external audiences.
• Exercise, enforce, and comply with legal rights and obligations – This includes responding to subpoenas, court orders, or other legal processes; investigating, preventing, or taking action regarding illegal activities, suspected fraud, security or technical issues; protecting the rights, property, or safety of ICE or others; and complying with applicable law.

ICE may also request your consent for additional uses of information, including Personal Information, and will use such information only for the purposes described to you. All uses of Personal Information are subject to applicable law.

How Your Information Is Shared

ICE may share information, including Personal Information, with third parties for the following purposes:

• Service providers, contractors, and other third parties – ICE may share information with service providers, contractors, and other third parties that help us carry out the activities described above, including providers you choose to contact through the ICE Marketplace.
• ICE requires relevant third parties to:
  1. comply with this Privacy Policy and applicable law;
  2. handle Personal Information confidentially and maintain appropriate security measures; and
  3. use Personal Information only as necessary to fulfill the relevant purpose.
• Third-party services and websites – In some cases, the ICE website may integrate with third-party services or contain links to websites published by third parties, including content providers and other service providers. These third parties are responsible for their own privacy practices. You should review the privacy policies of third-party websites whenever you are directed to them.
• Other visitors to the ICE website – Information may be shared with other visitors to create an interactive community environment. This may include opportunities to communicate with other users who have similar educational interests or goals, such as recommending particular platform partners.
• ICE affiliates and successors – Information may be shared with ICE affiliates or with successors in the event of a merger, acquisition, or reorganization, for purposes consistent with this Privacy Policy.

ICE may also request your consent for additional disclosures of information, including Personal Information, and will share such information only as described to you.

In addition, ICE may share with the public and with third parties, including researchers and business partners, information that has been de-identified or aggregated in a manner that does not personally identify you.
