ICE Institute Terms and Conditions of Use

These Terms and Conditions are effective as of July 28, 2021.

ICE Institute reserves the right to modify, update, add, or remove any part of these Terms and Conditions from time to time without prior notice.

Any changes will become effective when they are published on this page, unless otherwise stated. The effective date will be updated when material changes are made to these Terms and Conditions.

By continuing to access or use the ICE Institute Services after such changes have been published, you acknowledge that you have read, understood, and agreed to the revised Terms and Conditions.

If you do not agree with any changes to these Terms and Conditions, you must discontinue your use of the ICE Institute Services.

You are responsible for your use of the ICE Institute Services and for all content that you submit or publish.

"User Content" means any content submitted, uploaded, published, or distributed by a user through the ICE Institute Services, including discussion forum posts, comments, questions, notes, answers, wiki edits, videos, images, documents, and other files or materials.

You agree to use the ICE Institute Services in accordance with these Terms and Conditions and all applicable local, national, and international laws, rules, and regulations.

You may not use the ICE Institute Services for any purpose that may damage or interfere with ICE Institute systems, disable or overburden ICE Institute servers, interfere with connected networks, disrupt another user's use of the Services, obtain unauthorized access to systems or accounts, obtain information through unauthorized means, or otherwise compromise the security, integrity, or availability of the ICE Institute Services.

You may not attempt to gain unauthorized access to the ICE Institute Services, another user's account, computer systems, servers, or networks connected to ICE Institute through hacking, password cracking, vulnerability exploitation, or any other means.

You may not use automated methods, software, scripts, or other tools to download ICE Institute content in bulk without authorization, including user lists, user directories, User Content, user information, digital textbooks, course materials, trademarks, logos, or other content.

You may not provide false or misleading information regarding your identity when using the ICE Institute Services.

Users are prohibited from uploading, publishing, distributing, or sharing content that:

1. defames, harasses, threatens, intimidates, or harms another person;
2. promotes, facilitates, or supports illegal activities;
3. infringes the intellectual property rights of another person or organization, including copyrights and trademarks;
4. is pornographic, obscene, or otherwise unlawful;
5. contains hate speech, discrimination, or hostility toward an individual or group;
6. contains advertisements or unauthorized commercial solicitation;
7. contains viruses, Trojan horses, worms, malware, spyware, or other malicious software;
8. contains false, misleading, or materially inaccurate information;
9. contains another person's personal data without the required authorization or permission;
10. is intended to commit fraud, manipulate, or abuse the ICE Institute Services; or
11. violates any applicable law or regulation.

ICE Institute reserves the right to remove or restrict access to User Content that it reasonably believes violates these Terms and Conditions or applicable law.

You may be required to create an account to access certain features of the ICE Institute Services.

During registration, you may be required to provide information such as your full name, email address, country or region of residence, username, password, and other information necessary to provide the Services.

You are responsible for ensuring that all information provided is true, complete, accurate, and current. You must update your account information when necessary.

You are responsible for maintaining the confidentiality of your password and account credentials.

You may not share your password with another person, provide access to your account to a third party, sell or transfer your account, use another person's account, or allow another person to use your account.

If you become aware of or suspect unauthorized access to your account, you should take appropriate action immediately and contact ICE Institute when necessary.

ICE Institute provides a variety of courses and learning programs that may be developed by ICE Institute or by participating institutions and course partners.

Course availability, schedules, materials, instructors, requirements, prices, and access periods may vary from one course to another.

By enrolling in a course, you agree to the terms and requirements applicable to that course.

Access to a course may depend on your enrollment status, payment status, course requirements, and other applicable conditions.

ICE Institute or the institution developing a course may establish specific requirements that must be satisfied to access certain parts of a course.

ICE Institute or the relevant course institution may modify, update, postpone, or discontinue a course when necessary for academic, technical, administrative, operational, or other legitimate reasons.

If a material change to a course affects a user's rights, ICE Institute will provide information in accordance with applicable policies.

For paid courses or services, users must make payment according to the price and payment methods available at the time of the transaction.

Prices displayed on course pages or during checkout may change from time to time. The price applicable to a transaction is the price displayed and confirmed at the time the transaction is completed, unless there is a material technical or administrative error.

ICE Institute may offer promotions, discounts, vouchers, or promotional codes subject to specific terms and validity periods.

Promotions and discounts may be subject to additional conditions and may be limited to specific courses, users, periods, or payment methods.

Payment is considered successful after ICE Institute or the applicable payment provider receives payment confirmation in accordance with the applicable payment process.

ICE Institute reserves the right to reject or cancel a transaction if there is an indication of fraud, system abuse, unauthorized payment, material pricing error, or other circumstances permitted by applicable law and ICE Institute policies.

Cancellation and refund policies depend on the type of transaction, course, payment method, and refund policy applicable at the time of purchase.

Users may submit a refund request if they meet the requirements established by ICE Institute.

A refund request may be rejected if the request does not meet the applicable requirements, is submitted after the applicable deadline, the course has been substantially used, the user has violated these Terms and Conditions, the transaction was made using a non-refundable payment method or promotion, or for other reasons permitted by applicable policy.

If a refund is approved, the refund will be processed through the method or mechanism determined by ICE Institute or the relevant payment provider.

Refund processing times may vary depending on the payment method and payment provider.

All content available through the ICE Institute Services is protected by applicable copyright and intellectual property laws, unless expressly identified as being in the public domain or made available under a specific license.

Content may include text, videos, audio, images, presentations, examinations, quizzes, digital books, learning materials, documents, logos, trademarks, and other materials.

Course materials provided through ICE Institute are intended for personal and educational use in accordance with the access rights granted to the user.

Users may not reproduce, sell, distribute, republish, transmit, modify, or commercially use such materials without written permission from the rights holder or authorized party.

Certain materials may be provided with permission from third parties and may be subject to additional terms. Users are required to comply with those terms.

By uploading or submitting User Content to the ICE Institute Services, you represent that you have the necessary rights or permissions to use and share that content.

You retain ownership of User Content that you own, to the extent permitted by applicable law.

You grant ICE Institute the rights necessary to store, process, display, and use User Content to the extent necessary to provide, operate, secure, and improve the ICE Institute Services.

ICE Institute does not intend to acquire ownership of your intellectual property rights merely because you use the ICE Institute Services.

ICE Institute may provide Certificates of Achievement or verified certificates to users who meet the requirements of a particular course.

Certificate requirements may vary by course and are determined based on the applicable academic, assessment, and course completion requirements.

Certificates may be issued by ICE Institute on behalf of the institution that develops or provides the course.

The decision as to whether a user meets the requirements for a certificate is at the discretion of the course-developing institution or other authorized awarding party.

ICE Institute does not guarantee that every user will receive a certificate solely because they have enrolled in a course.

ICE Institute reserves the right to modify the Services and courses from time to time.

Changes may include learning materials, schedules, instructors, course structure, platform features, assessment methods, completion requirements, prices, or course availability.

ICE Institute may suspend or discontinue a service or course when necessary for technical, academic, security, operational, legal, or other legitimate reasons.

ICE Institute may suspend, restrict, or terminate a user's account or access to the Services if the user violates these Terms and Conditions, violates applicable law, abuses the Services, threatens system security, provides false or misleading information, commits fraud or transaction abuse, or engages in conduct that may harm ICE Institute, other users, or third parties.

In certain circumstances, ICE Institute may take such action without prior notice when necessary to protect system security or prevent harm.

Termination of an account does not eliminate obligations that, by their nature, are intended to survive termination.

ICE Institute respects the privacy of its users.

The collection, use, storage, and processing of user personal data are carried out in accordance with the ICE Institute Privacy Policy and applicable laws and regulations.

By using the ICE Institute Services, you understand that certain data may be required to provide and manage the Services.

ICE Institute makes reasonable efforts to keep the Services available, secure, and functional.

However, ICE Institute does not guarantee that the Services will always be available without interruption or free from errors.

The Services may experience temporary interruptions due to maintenance, updates, network problems, hardware or software failures, third-party service disruptions, force majeure events, or other factors beyond ICE Institute's reasonable control.

ICE Institute will make reasonable efforts to restore the Services when an interruption occurs.

To the extent permitted by applicable law, the ICE Institute Services are provided on an "as is" and "as available" basis.

ICE Institute does not guarantee that the Services will always be available, that all content will be error-free, that every course will meet a user's specific needs or objectives, that users will achieve specific academic or professional outcomes, that third-party materials will always remain available or unchanged, or that the Services will be free from technical interruptions.

Information provided through the ICE Institute Services is not intended to replace professional, academic, legal, medical, financial, or other professional advice where such advice is required.

To the extent permitted by applicable law, ICE Institute shall not be liable for indirect, incidental, special, consequential, or other losses arising from the use of or inability to use the ICE Institute Services.

Nothing in these Terms and Conditions is intended to exclude or limit liability that cannot legally be excluded or limited under applicable law.

Users remain responsible for the use of their accounts, transactions, and activities conducted through their accounts.

The ICE Institute Services may contain links, materials, services, or integrations provided by third parties.

Third parties may have their own terms and privacy policies.

ICE Institute is not responsible for the content, policies, security, availability, or practices of third parties that are outside ICE Institute's control.

Use of third-party services may be subject to the terms and conditions established by the applicable third party.

ICE Institute shall not be liable for any failure or delay in providing the Services caused by circumstances beyond its reasonable control, including natural disasters, fire, flooding, network or infrastructure disruptions, third-party system failures, war, civil unrest, pandemics, government actions, or other extraordinary circumstances.

ICE Institute will make reasonable efforts to restore the Services after such circumstances have ended.

Users must use the ICE Institute Services in compliance with all applicable laws and regulations.

Users may not use the Services to conduct unlawful activities or assist another person in violating applicable laws.

ICE Institute may take appropriate action when there is a reasonable indication of unlawful activity or when required by a lawful request from an authorized authority.

These Terms and Conditions shall be governed by and interpreted in accordance with the laws of the Republic of Indonesia.

Any dispute arising in connection with the use of the ICE Institute Services shall first be resolved through good-faith discussion and amicable settlement.

If an amicable settlement cannot be reached, the dispute shall be resolved through the applicable dispute resolution mechanism in accordance with the laws of the Republic of Indonesia.

If any provision of these Terms and Conditions is determined to be invalid, unlawful, or unenforceable under applicable law, that provision shall be modified or removed to the extent necessary.

The invalidity or unenforceability of any provision shall not affect the validity and enforceability of the remaining provisions.

These Terms and Conditions, together with the ICE Institute Privacy Policy and any other policies specifically applicable to a particular Service or course, constitute the terms governing your use of the ICE Institute Services.

Where specific terms apply to a particular course or service, those terms may apply in addition to these Terms and Conditions.

ICE Institute will make reasonable efforts to respond to user questions or requests within a reasonable period of time.
